Terms and Conditions
- Only a qualified individual may enroll in the Louisiana Armed Citizen’s Plan (“The Plan”) . A “qualified individual” is a natural person who is a United States citizen and who has no history or condition which disqualifies the individual from ownership and/or possession of a firearm. Examples of such a history or condition include, but are not limited to, mental incompetence, felony criminal records, any pending felony or disqualifying criminal matter, a record of domestic violence, or a current domestic restraining order.
- Membership creates a client-attorney relationship between the Member and Allison & Allison, LLC (“attorney”). The enrollment fee, consisting of an initial enrollment fee and periodical monthly fees, is considered a “true retainer.” The fee is to ensure the availability of the Attorney to handle particular legal matters on behalf of the Member. The enrollment fee is a fee that is considered earned upon payment.
- Enrollment in The Plan occurs upon receipt of the executed enrollment form and payment of the initial enrollment fee.
- Services provided under the terms of the plan are restricted to Members of The Plan.
- Membership by an individual who is not a “qualified individual” as the term is defined hereinabove is null and void. If a member is discovered to have a disqualifying condition, membership is terminated immediately.
- As a benefit of membership, members receive up to $10,000 of legal fees whenever they are involved in a self-defense shooting. The scope of representation is limited to defense of the Member against criminal charges that may arise from the shooting. This covers attorney time and paralegal time only. It does not include expenses. This benefit is void if the member was not a qualified individual at the time of the shooting or if the shooting occurred before the benefit became available.
- Legal services are billed in quarter-hour increments at the Attorney’s standard billing rate.
- The standard billing rate is $200.00 per hour for attorney time and $60 per hour for paralegal time.
- The Plan is a state-wide service. Mileage expense, meals, lodging, and travel time are not charged for any travel within the State of Louisiana.
- Member agrees to allow Attorneys to involve the services of competent attorneys outside the firm of Allison & Allison (Network Attorneys) to assist with specific legal engagements.
- Members may secure legal services for specific matters at any time. Member agrees to be charged automatically for services received using the credit card information provided upon enrollment or updated thereafter. Given oral authorization by the Member for a specific legal service engagement, Member agrees Attorneys may charge up to $250 total fees and expenses for the specific engagement.
- A specific engagement which is reasonably expected to require more than $250 in fees and expenses requires the execution of a written engagement agreement before services are rendered. In an urgent situation, the attorney may begin services immediately, but will limit billing to $250. Member agrees that attorney may terminate the engagement once $250 worth of services have been rendered if other written arrangements have not been executed.
- Expenses directly attributable to a specific legal engagement may be charged to Member’s credit card. Phone and fax services are not charged. Mileage is not charged. Copies are charged at .25 per page. An accounting and processing fee of 5% of any expense is added to invoiced costs. This paragraph does not apply in any matter handled by attorney in which costs and expenses are advanced by Attorney.
- If any charge to a member using the credit card information provided upon enrollment or updated thereafter is declined or reversed, engagement of the attorney’s services may be terminated immediately at the discretion of Attorney.
- If any amount charged to a Member requires collection activity, Member agrees to pay any costs associated with the collection activity, including attorney fees whether they are fees for an outside service or fees generated by activity of Allison & Allison, LLC. A reasonable attorney fee for collection activity is a minimum of 25% of the amount due or $200 per hour, whichever is more.
- Attorney cannot guarantee the confidentiality of any email in plain text sent or received on behalf of Member. If encryption is desired, the member should contact Attorney to make suitable arrangements.
- The monthly enrollment fee is automatically charged every month at or near the same date of the original enrollment unless Membership is cancelled by the member. Membership may be terminated by member at any time.
- Attorney makes no promises or guarantees regarding the outcome of any engagement of legal services.
- Attorney has the right to withdraw from any engagement if, in his judgment, the Rules of Professional Conduct may be violated by his continued involvement in the matter.
- Plan terms, conditions, and rates are subject to change. Notice of changes are placed on the Plan’s Website at http://www.louisianaarmedcitizens.com/. Members are considered notified upon posting of any change to the Plan’s Website.
